Article 2-Definitions
Smartsapiens: the trade name of the company that offers products and workshops via the webshop.
Customer: the natural or legal person who purchases a product or service from Smartsapiens.
Webshop: the online environment of Smartsapiens where orders and bookings can be made.
Products: the Smartsapiens Challenge (journal + cards + dice), future card games and other physical or digital materials offered via the webshop.
Services: workshops and other support activities for which customers can register via the webshop.
Agreement: the agreement between Smartsapiens and the customer regarding the purchase of a product or service.
Article 3-Applicability
These general terms and conditions apply to all purchases and bookings via the Smartsapiens webshop.
Deviations from these conditions are only valid if agreed in writing.
If any provision of these terms and conditions is found to be void or Invalid, the remaining provisions shall remain in full force and effect.
Article 4-offer and agreement
All offers on the Smartsapiens webshop are without obligation and can be revoked at any time.
An agreement is concluded when Smartsapiens confirms an order or booking in writing.
Smartsapiens reserves the right to refuse an order or registration without giving a reason.
Article 5-prices and payment
All prices on the webshop are in euros and include VAT, unless otherwise stated.
Payment must be made in advance via the payment methods offered on the webshop.
Smartsapiens reserves the right to change prices and conditions. The amendments do not apply to agreements already concluded.
In case of late payment, Smartsapiens reserves the right to cancel the order or booking.
Article 6-delivery and execution
Products are shipped within the specified delivery time. Delayed delivery does not entitle you to compensation.
Workshops will be conducted on the agreed date and location or online if applicable.
Smartsapiens reserves the right to make changes to the execution of workshops if necessary.
If a product is not in stock, the customer will be informed about this and the customer can choose for a refund or later delivery.
Article 7-cancellation and returns
Customers can return physical products within 14 days of receipt, provided unused and in original condition.
Digital products and workshops already delivered cannot be returned.
Cancellation of a workshop is free of charge up to 7 days before the start. In case of subsequent cancellation, 50% of the cost will be charged.
In case of force majeure, Smartsapiens reserves the right to cancel or reschedule a workshop, without refund of the full amount.
Article 8-Liability
Smartsapiens is not liable for any damage resulting from the use of its products or services, unless there is intent or gross negligence.
The liability of Smartsapiens is limited to the invoice amount of the respective delivery.
Smartsapiens is not liable for consequential damage, including lost income, loss of data or any other indirect damage.
Article 9-Intellectual Property
All intellectual property rights to the products and services of Smartsapiens remain the property of Smartsapiens.
It is not permitted to copy, distribute or commercially use materials without written permission from Smartsapiens.
Article 10-Force Majeure
In case of force majeure, Smartsapiens is not obliged to fulfill its obligations and can suspend or terminate the agreement without compensation.
Force majeure means: disruptions in Internet connections, pandemics, strikes, government measures, delays at suppliers and other situations beyond the control of Smartsapiens.
Article 11-complaints and disputes
Complaints about products or services can be submitted in writing via [fill in email address]. Smartsapiens strives to respond within 14 days.
Dutch law applies to these general terms and conditions.
Disputes are preferably resolved by mutual agreement. If this is not possible, disputes will be submitted to the competent court in the Netherlands.
